Terms and Conditions

These terms and conditions apply when you use **lesleyrowe.co.uk** or purchase products from the Lesley Rowe Collection.

 

Please read them carefully before placing an order.


1. About us

 

The Lesley Rowe Collection is a trading name used by:

References in these terms to “we”, “us” and “our” mean Paul Rowe trading as the Lesley Rowe Collection.

 

References to “you” and “your” mean the person using this website or purchasing a product from us.


2. These terms

 

By placing an order through our website, you confirm that:

 

- You are at least 18 years old.

- The information you provide is complete and accurate.

- You are authorised to use the selected payment method.

- You agree to these terms and conditions.

Nothing in these terms affects your statutory consumer rights.

3. Our products

We sell products that may include:

- Greeting cards

- Fine-art and decorative prints

- Art-and-poetry pieces

- Mounted and framed artwork

- Original artwork

- Personalised or commissioned artwork

- Other related art products

The product description shown on the relevant product page forms part of your order.

We take reasonable care to display products accurately. However, colours may appear slightly different depending on your screen, device and display settings.

Measurements are approximate unless expressly stated otherwise.

Hand-finished, handmade and individually produced items may contain minor variations. These variations are part of the character of the product and will not normally be considered faults.

Frames, mounts and printed products may also vary slightly between production batches.

4. Placing an order

When you place an order, you are making an offer to purchase the products in your basket.

You will receive an automated email acknowledging that we have received your order. This acknowledgement does not necessarily mean that your order has been accepted.

A contract between you and us is formed when we send an order confirmation or notify you that your order has entered production or been dispatched.

We may decline or cancel an order where:

- A product is unavailable.

- There is an error in its description or price.

- We cannot obtain authorisation for payment.

- We cannot deliver to the address provided.

- We reasonably suspect fraud or unauthorised activity.

- The order breaches these terms.

Where payment has already been taken for an order we cannot fulfil, we will issue a refund.

 

5. Prices and payment

 

All prices are shown in pounds sterling.

 

Prices include any applicable UK taxes unless otherwise stated. Delivery charges are shown separately before you confirm your order.

Payment must be made using one of the payment methods offered during checkout.

Payments are processed securely through Wix Payments or another payment provider shown at checkout. We do not receive or retain your complete card details.

We may change our prices at any time. Price changes will not affect orders that we have already accepted.

If an obvious pricing error occurs, we may contact you to offer the product at the correct price or cancel the order and issue a refund.

6. Availability

All products are subject to availability.

Original artwork and limited items may be available in single or restricted quantities. Occasionally, an item may be purchased by more than one customer before the website updates.

 

Where this happens, we will contact the affected customer and provide a refund or, where appropriate, offer an alternative.

 

7. Production times

 

Some products are printed, mounted, framed or finished after an order is received.

 

Estimated production and dispatch times will be shown on the product page or provided in your order confirmation.

 

Production and dispatch dates are estimates rather than guaranteed dates unless we have expressly agreed a specific deadline with you.

 

Please contact us before ordering when a product is required for a particular date.

 

8. Delivery

 

We currently deliver to addresses within the United Kingdom unless the product page or checkout states otherwise.

 

Available delivery methods, estimated times and charges will be displayed before you complete your order.

 

Unless a different period has been agreed with you, we will deliver your order within 30 days of accepting it.

 

You are responsible for supplying a complete and accurate delivery address.

 

We are not responsible for delays or failed deliveries caused by:

 

- An incorrect or incomplete address supplied by you.

- No one being available to accept the delivery.

- Delays outside our reasonable control.

 

Responsibility for the product passes to you when it is delivered to you, or to another person identified by you to receive it.

 

Ownership of the product passes to you once we have received full payment.

 

9. Local collection

Where local collection is offered, collection details will be confirmed after your order has been accepted.

Products must not be collected until you have received confirmation that they are ready.

You may be asked to provide your order confirmation or another reasonable form of identification.

10. Your right to cancel an online order

For most standard products purchased online, you may cancel your order without giving a reason.

The cancellation period begins when the contract is formed and ends 14 days after:

- You receive the product; or

- You receive the final product where one order is delivered in separate parts.

To cancel, you must clearly tell us that you have decided to cancel. You may do this by email, post or by using the cancellation form at the end of these terms.

You do not have to use the cancellation form.

Please include:

- Your name

- Your order number

- Your address

- The product being returned

- The date you received it

 

11. Returning a cancelled order

 

After telling us that you wish to cancel, you must return the product within 14 days.

 

Unless the product is faulty, damaged or incorrectly supplied, you are responsible for the direct cost of returning it.

 

Products should be:

 

- Returned securely packaged.

- Protected against damage in transit.

- Returned with any accessories or components supplied.

- Sent using an appropriately insured and trackable service where valuable or fragile.

 

You may inspect a product as you would reasonably be able to inspect it in a shop.

 

We may reduce the refund where the product’s value has been reduced because it has been handled more than was reasonably necessary to establish its nature, characteristics and condition.

 

You remain responsible for the returned product until it reaches us.

 

Contact us before returning an item so that we can provide the correct returns address and instructions.

 

12. Refunds following cancellation

 

Where you validly cancel an order, we will refund:

 

- The price paid for the returned product.

- The cost of our least expensive standard delivery method, where applicable.

 

We are not required to refund the additional cost of an enhanced, express or premium delivery service selected by you.

 

We may withhold the refund until:

 

- We receive the returned product; or

- You provide evidence that it has been sent back.

We will make the refund within 14 days of receiving the returned product or satisfactory evidence of its return.

Refunds will normally be made to the original payment method.

13. Personalised and custom-made products

The statutory right to cancel does not normally apply to products that are:

- Made to your individual specifications.

- Clearly personalised.

- Created using photographs, names, wording or other material supplied by you.

- Commissioned specifically for you and unsuitable for resale.

We will identify products that fall within this exception before you place your order.

Simply choosing from standard sizes, colours, frames or other standard options will not automatically mean that a product is personalised or custom-made.

Your rights remain unaffected where a personalised or commissioned product is faulty, damaged, not as described or incorrectly supplied.

Any additional terms, approval stages, deposits, timescales or cancellation arrangements applying to a commission will be set out in the relevant quotation or commission agreement.

14. Customer-supplied photographs and material

Where you provide a photograph, image, poem, wording or other material for use in a personalised product, you confirm that:

- You have permission to provide and use it.

- Its use will not infringe another person’s copyright, privacy or other rights.

- It does not contain unlawful, abusive or offensive material.

- Any people shown have given any permission reasonably required for its use.

We may refuse material that we reasonably consider inappropriate or unlawful.

Customer material will be handled in accordance with our Privacy Policy.

 

15. Faulty, damaged or incorrect products

We are responsible for supplying products that are:

- As described.

- Of satisfactory quality.

- Fit for any purpose made known to us before purchase.

Please inspect your order promptly after delivery.

Contact us as soon as reasonably possible if a product:

- Arrives damaged.

- Is faulty.

- Is not as described.

- Is different from the product ordered.

- Has been damaged during delivery.

Please provide your order number and, where reasonably requested, photographs showing the problem and the packaging.

Depending on the circumstances and your statutory rights, we may offer:

- A full or partial refund.

- A repair.

- A replacement.

- A corrected product.

Where a product is confirmed as faulty or incorrectly supplied, we will reimburse reasonable return costs or arrange its return.

Damage caused by misuse, accidental damage, inappropriate storage, unauthorised alteration or ordinary wear and tear is not treated as a product fault.

16. Framed artwork and glass

Framed artwork should be handled carefully.

Glass and glazing materials may break or cause injury if damaged. You are responsible for ensuring that framed products are hung or displayed using fixings suitable for the wall, product weight and location.

We recommend using an experienced installer for large or heavy framed pieces.

This does not exclude our responsibility for supplying a product that is safe, correctly described and of satisfactory quality.

17. Copyright and intellectual property

All copyright, intellectual property and other rights in the website and its contents remain with us or the relevant rights holder.

This includes rights in:

- Artwork

- Paintings and illustrations

- Photographs

- Poems and written work

- Product designs

- Digital images

- Logos and branding

- Page layouts and website content

Purchasing an original artwork, print, card or other product does not transfer copyright or reproduction rights to you.

Products are supplied for personal use unless we have agreed otherwise in writing.

You must not reproduce, scan, copy, publish, sell, licence, distribute, modify or commercially exploit any artwork, image or written work without prior written permission from the copyright owner.

You may resell a physical product that you lawfully own, but this does not give you the right to reproduce its artwork or written content.

18. Website use

 

You may use this website for lawful personal purposes.

You must not:

- Attempt to gain unauthorised access to the website.

- Introduce viruses or malicious software.

- Interfere with the operation or security of the website.

- Scrape or systematically extract website content.

- Use website content for unauthorised commercial or artificial-intelligence training purposes.

- Misrepresent your identity or payment authority.

We may suspend access where we reasonably believe these terms have been breached.

 

19. Third-party services and links

Our website may contain links to services operated by other organisations, including payment, delivery and social-media providers.

We are not responsible for the content or availability of third-party websites.

Your use of a third-party service may also be governed by that provider’s terms and privacy policy.

20. Our responsibility to you

We do not exclude or limit liability where doing so would be unlawful.

This includes liability for:

- Death or personal injury caused by our negligence.

- Fraud or fraudulent misrepresentation.

- Breach of your statutory consumer rights.

- Any other liability that cannot legally be excluded.

We are responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Products sold through this website are intended primarily for domestic and personal use. We are not responsible for business losses, loss of profit, loss of revenue or loss of business opportunity arising from use of a product for commercial purposes unless otherwise agreed in writing.

21. Events outside our control

We are not responsible for delay or failure caused by circumstances outside our reasonable control.

These may include:

- Severe weather

- Fire or flooding

- Postal or courier disruption

- Transport failure

- Utility or internet failure

- Supplier interruption

- Industrial action

- Government restrictions

- Serious illness or emergency

We will contact you where practical and take reasonable steps to minimise the effects of the delay.

If a substantial delay occurs, you may have the right to cancel the affected order and receive a refund for products not supplied.

 

22. Privacy

 

We process personal information in accordance with our Privacy Policy.

Please read the Privacy Policy before supplying personal information or joining our mailing list.

Please include your name, order number and a clear description of the problem.

We will acknowledge your complaint and try to resolve it fairly and promptly.

24. Changes to these terms

We may update these terms to reflect changes in our products, services, business arrangements or legal obligations.

The terms applying to your purchase will normally be those displayed when you place your order.

The date of the latest revision appears at the top of this page.

25. Severability

If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

26. Third-party rights

These terms are between you and us.

No other person has the right to enforce them unless expressly stated otherwise.

27. Governing law

These terms are governed by the law of England and Wales.

If you live in England or Wales, legal proceedings may be brought in the courts of England and Wales.

If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the United Kingdom in which you live.
